Chapter 3 — Crimes Against Property

Article I — General Overview

§301. Definition.
Crimes against property involve unlawful interference with the ownership, possession, or use of real or personal property belonging to another.
They encompass theft, vandalism, burglary, arson, and other acts resulting in loss or damage to property.

§302. Intent Requirement.
Except where negligence is specified, property crimes require intentional or knowing conduct.

§303. Classification.
Penalties depend on the value of the property involved, the degree of damage, and the method of commission.


Article II — Theft and Larceny

S.A.R.P.C. §310 — Petty Theft (Class B Misdemeanor)
Unlawful taking of property valued under $2,500.
Penalty: 5–10 min jail, $1,500 fine.

S.A.R.P.C. §311 — Grand Theft (Class B Felony)
Unlawful taking of property valued over $2,500.
Penalty: 15–25 min jail, $3,500 fine.

S.A.R.P.C. §312 — Auto Theft (Class A Felony)
Theft or unauthorized use of a motor vehicle.
Penalty: 25–35 min jail, $4,500 fine.

S.A.R.P.C. §313 — Possession of Stolen Property (Class B Felony)
Knowingly possessing, concealing, or selling stolen property.
Penalty: 15–25 min jail, $3,500 fine.

S.A.R.P.C. §314 — Shoplifting (Class C Misdemeanor)
Removing merchandise from retail premises without payment.
Penalty: $1,000 fine.

S.A.R.P.C. §315 — Embezzlement (Class B Felony)
Fraudulent appropriation of property by a person entrusted with it.
Penalty: 15–25 min jail, $3,500 fine.


Article III — Burglary and Trespassing

S.A.R.P.C. §320 — Burglary (Class B Felony)
Entering any structure with the intent to commit a felony or theft.
Penalty: 15–25 min jail, $3,500 fine.

S.A.R.P.C. §321 — Home Invasion (Class A Felony)
Entering an occupied dwelling with the intent to commit a crime and cause harm.
Penalty: 25–40 min jail, $5,000 fine.

S.A.R.P.C. §322 — Criminal Trespass (Class C Misdemeanor)
Entering or remaining on property without permission.
Penalty: $1,000 fine.

S.A.R.P.C. §323 — Trespass with Intent (Class B Misdemeanor)
Trespassing with intent to commit an additional offense.
Penalty: 5–10 min jail, $1,500 fine.


Article IV — Arson and Property Damage

S.A.R.P.C. §330 — Arson (Class A Felony)
Intentional burning or explosion damaging property or endangering life.
Penalty: 30–40 min jail, $5,000 fine.

S.A.R.P.C. §331 — Attempted Arson (Class B Felony)
Taking substantial steps toward the commission of arson.
Penalty: 20–25 min jail, $3,500 fine.

S.A.R.P.C. §332 — Criminal Mischief / Vandalism (Class B Misdemeanor)
Willful destruction or defacement of property.
Penalty: 5–10 min jail, $1,500 fine.

S.A.R.P.C. §333 — Graffiti (Class C Misdemeanor)
Marking property without consent using paint, ink, or etching.
Penalty: $750 fine and community service.


Article V — Fraud and Deception

S.A.R.P.C. §340 — Fraud (Class B Felony)
Obtaining money, property, or services by deception.
Penalty: 15–25 min jail, $3,500 fine.

S.A.R.P.C. §341 — Forgery (Class B Felony)
Making or altering documents with the intent to defraud.
Penalty: 15–25 min jail, $3,500 fine.

S.A.R.P.C. §342 — Identity Theft (Class A Felony)
Using another’s identity for unlawful gain or impersonation.
Penalty: 25–35 min jail, $4,500 fine.

S.A.R.P.C. §343 — Check Fraud (Class B Misdemeanor)
Issuing a check knowing insufficient funds exist.
Penalty: $1,500 fine.

S.A.R.P.C. §344 — Insurance Fraud (Class A Felony)
Filing false claims or staging incidents for financial benefit.
Penalty: 25–35 min jail, $4,500 fine.


Article VI — Extortion and Blackmail

S.A.R.P.C. §350 — Extortion (Class A Felony)
Obtaining money or property through threat or intimidation.
Penalty: 25–35 min jail, $4,500 fine.

S.A.R.P.C. §351 — Blackmail (Class B Felony)
Threatening to reveal information to gain an advantage or property.
Penalty: 15–25 min jail, $3,500 fine.


Article VII — Enforcement Notes

  • All property crimes require victim or witness statements when possible.
  • Damage valuation determines classification; officers should document photographic evidence.
  • Stolen property recovery should be recorded for restitution purposes.
  • Fraud and forgery cases must include transaction or record evidence.
